By accessing or using this Site, you agree to be bound by these Terms of Use, along with our Privacy Policy, Telehealth Consent, Notice of Privacy Practices (HIPAA), and any additional terms that may apply to specific areas of the Site or to services offered through the Site. Accessing the Site in any manner, whether automated or otherwise, constitutes your acceptance of these Terms of Use.

We reserve the right to update or modify these Terms of Use at any time. Any changes will be posted on the Site. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

1. INTELLECTUAL PROPERTY RIGHTS

The Site and all materials contained on it, including text, graphics, logos, videos, downloads, and design elements, are the property of COMPANY or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and download one copy of materials from the Site solely for your personal, non-commercial use, provided that all copyright and proprietary notices remain intact. You may not reproduce, modify, republish, upload, post, transmit, distribute, create derivative works, or otherwise exploit the Site or its materials for any commercial purpose without our express written permission.

COMPANY provides mental health services via telehealth. In accordance with Florida law (Fla. Stat. § 456.47), we adhere to the same standard of care whether services are provided via telehealth or in person. Our clinicians provide services only to clients located in Florida at the time of the appointment. All providers delivering telehealth services are appropriately licensed or registered in the State of Florida. Some providers may hold out-of-state licensure and are registered with the Florida Department of Health to provide telehealth services to patients located in Florida.

If you are experiencing a mental health crisis or emergency, please call 911 or go to your nearest emergency room. This practice does not provide emergency or crisis intervention services.

In accordance with Fla. Stat. § 39.201, providers at this practice are mandated reporters under Florida law and may be required to report suspected child abuse, abuse of vulnerable adults, or threats of harm to self or others.

Contacting us or submitting information through this website does not create a provider-patient relationship. A therapeutic relationship is established only after intake forms are completed, eligibility is confirmed, and an appointment is scheduled.

Do not submit personal medical information through this website. Communications through this site are not encrypted or fully HIPAA-compliant. Established patients should use the secure patient portal for any protected health information. HIPAA-compliant communication is available only through our secure patient portal, not through email, contact forms, or social media.

3. ONLINE COMMERCE

To the fullest extent permitted by law, COMPANY is not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from your use of the Site or inability to access the Site. Your sole remedy for dissatisfaction with the Site is to stop using it.

7. HEALTH AND WELLNESS CONTENT

The Site may include general mental-health or wellness information. This content is educational in nature and does not constitute psychiatric or medical advice, diagnosis, or treatment. You should not rely on Site content for treatment decisions or emergency concerns. The Site is not a substitute for professional healthcare services.

8. TERMINATION

COMPANY may suspend or terminate your access to the Site at any time, without notice, for any reason. All disclaimers, indemnity obligations, and limitations of liability urvive termination.

9. REFUND POLICY

Refund policies for services or programs will be provided at the point of purchase. Unless otherwise stated, all services are non-refundable once rendered or once a session has begun.

10. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

If you believe that a notice of copyright infringement has been wrongly filed against you, the DMCA permits you to send to COMPANY a counter-notice. All notices and counter notices must meet the then current statutory requirements imposed by the DMCA. COMPANY’s Copyright Agent for notice shall be Emma Hovey, PA-C.

11. ASSIGNMENT

COMPANY may assign its rights under these Terms to any subsidiary, successor entity, or affiliated organization. You may not assign your rights or obligations without our prior written consent.

12. DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Florida. Any dispute arising under these Terms shall be resolved through binding arbitration in Florida, except for claims eligible for small claims court. This arbitration clause does not apply to medical malpractice claims unless the patient separately signs a voluntary binding arbitration greement as required under Florida Statutes § 766.207.

13. CLASS ACTION WAIVER

You may only resolve disputes with us individually and cannot participate as a plaintiff or class member in any class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and combining multiple claims in arbitration are not permitted. The arbitrator is not allowed to combine claims from multiple people or oversee any type of class or representative proceeding (including class actions, consolidated actions, or private attorney general actions) unless all parties involved explicitly agree to it after the arbitration has begun.

14. SEVERABILITY

If any part of these Terms of Service (except for the Class Action Waiver clause above) is deemed illegal or unenforceable, that specific part will be removed, and the rest of the Terms of Service will remain fully effective. However, if the Class Action Waiver clause itself is found to be illegal or unenforceable, this entire provision will be invalid, and any dispute will be resolved by a court.
